Terms, Community Standards & Privacy

These Terms of Service ("Terms") are a binding legal agreement between you and the operator of Out of the Claudeset (the "Service," "we," "us," or "our"), a Flamingo Time production. By creating an account, checking the agreement box, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy below. If you do not agree, do not use the Service.
1. What the Service is
The Service is an AI-focused news aggregator and community discussion board. It (a) aggregates publicly available headlines and short excerpts from third-party sources and links back to the originals, (b) publishes our own editorial content, and (c) provides a forum where registered users may post and discuss. The Service is intended to encourage constructive discussion.
2. Eligibility & accounts
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is greater) to use the Service. You are responsible for all activity under your account and for keeping your credentials secure. Choose a public display name (handle) — we recommend not using your real name. Do not impersonate any person or entity. We may suspend or terminate accounts at our discretion, including for violations of these Terms.
3. Community Standards & acceptable use
This is a place for good-faith, constructive conversation. The following are strictly prohibited and will result in content removal and, for repeat or severe conduct, a permanent ban:
- Threats of violence, harm, or death toward any person or group.
- Abuse and harassment — targeting, demeaning, stalking, or coordinated pile-ons against a person.
- Bullying — sustained hostility intended to intimidate, humiliate, or silence.
- Hate speech — attacks or dehumanization based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or other protected characteristics.
- Doxxing — posting private or identifying information about others without consent.
- Illegal content, incitement, sexual content involving minors, spam, scams, malware, or attempts to compromise the Service or other users.
Profanity vs. abuse. We do not ban ordinary strong language — our automated filter masks profanity at display time while preserving your original entry, so the conversation stays civil and readable. Profanity weaponized against a person, however, is abuse and is covered by the prohibitions above. We reserve the right to determine, in our sole discretion, what constitutes a violation.
4. Your content & license
You retain ownership of the content you post ("User Content"). By posting, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that User Content for the purpose of operating, promoting, and improving the Service. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms or any law or third-party right. This license survives termination with respect to content others have already interacted with, and to the extent needed for backups and legal compliance.
5. User Content is yours, not ours
The Service hosts content created by users. We do not endorse, adopt, verify, or assume responsibility for any User Content, and views expressed by users are their own. Consistent with applicable law (including 47 U.S.C. § 230 in the United States), we act as an interactive computer service provider and are not the publisher or speaker of User Content. We are not obligated to monitor User Content, but we may remove or moderate any content at our discretion without notice.
6. Moderation & enforcement
Moderation is performed by our team and automated tooling. We may, without prior notice, mask, hide, lock, edit, remove, or refuse content, and may suspend, restrict, or permanently ban accounts. Decisions about abuse, harassment, and bans are made at our sole discretion. Moderation actions are logged. You may request review of a decision via the contact method listed on the Service, but we are not obligated to reinstate content or accounts.
7. Aggregated third-party content & copyright
Aggregated headlines, excerpts, and links remain the property of their original publishers and are displayed under fair-use / fair-dealing and standard syndication norms, with a link back to the source. Source "bias" and "factuality" labels are directional editorial indicators, synthesized from publicly available media-literacy assessments — they are opinions for media-literacy purposes, not statements of fact about any outlet, and are not intended to defame or disparage any publisher.
DMCA / copyright complaints. If you believe content on the Service infringes your copyright, send a notice with the information required by 17 U.S.C. § 512(c)(3) (identification of the work, the material, your contact information, a good-faith statement, and a statement under penalty of perjury) to our designated contact listed on the Service. We will respond to valid notices, including by removing infringing material and, where appropriate, terminating repeat infringers.
8. Disclaimers — no warranty
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT CONTENT (INCLUDING AGGREGATED OR USER CONTENT) IS ACCURATE, COMPLETE, OR RELIABLE. YOU USE THE SERVICE AT YOUR OWN RISK.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATOR, FLAMINGO TIME, OR THEIR AFFILIATES, OWNERS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY USER CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless the operator, Flamingo Time, and their affiliates and contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
11. Governing law & dispute resolution
These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws rules. To the extent permitted by law, you agree that any dispute will be resolved on an individual basis and you waive any right to participate in a class action or class-wide arbitration. Where binding arbitration is permitted and elected, disputes will be resolved by neutral arbitration; otherwise the state and federal courts located in Maryland will have exclusive jurisdiction, and you consent to that jurisdiction and venue. Nothing here prevents either party from seeking injunctive relief for intellectual-property or unauthorized-use matters.
12. Third-party connections
If you connect a third-party account (e.g., Google, Reddit, LinkedIn), you authorize us to access the minimum data needed via that platform's official OAuth flow. We never receive your password for those services and never post on your behalf. Access tokens are encrypted and stored server-side, never exposed to your browser or other users, and deleted when you disconnect. Your use of third-party services is governed by their terms, not ours.
13. Termination & changes
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access at any time, with or without cause. We may modify these Terms; material changes will be posted here with an updated version date and, where appropriate, require renewed agreement. Continued use after changes constitutes acceptance. Sections that by their nature should survive termination (including 4–11 and 14) will survive.
14. Privacy Policy
We are built to be privacy-respecting and pseudonymous. Publicly, the Service shows only your chosen handle and display name — never your email or real-world identity. We collect only what we need:
- Account data — your email (used solely for login, confirmation, and account recovery; never displayed publicly), your chosen handle/display name, and optional profile fields. Passwords are hashed by our authentication provider; we never see or store them in plain text.
- Activity — your posts, comments, votes, and feed preferences, so the Service works for you.
- Connection tokens — for any linked third-party account, encrypted and stored in a secure server-side vault, never exposed to your browser or to other users, and deleted on disconnect.
- Basic analytics — privacy-preserving, aggregate page-view counts with no personal identifiers, no cross-site tracking, and no sale of personal data.
We do not sell your personal data. We serve advertising on our own original pages; ad partners may set cookies subject to their own policies. You may request access to, correction of, or deletion of your personal data and account at any time via the contact method on the Service. We retain data only as long as needed to operate the Service or comply with legal obligations.
